RTS Financial Service, Inc. (“RTS Financial”) is committed to safeguarding your privacy on our websites located at www.rtsinc.com, www.pro-transport.com, (“Sites") and to our RTS Pro mobile application ("RTS Pro") made available at www.rtspro.com through the App Store, Google Play and a Windows desktop application. We use this privacy policy to clearly disclose to you our privacy practices in a manner that is easy to understand. This privacy policy does not apply to products or services provided, or information obtained, other than through our Sites, RTS Pro, ProTransport, and our other applications. We may change this policy from time to time so please check back often. If we significantly change our collection, use, or disclosure practices, we will try to send you a notice via email if you have provided us with an email address. Please keep in mind that some of the services mentioned specifically in this policy may not be available on the Sites at this time.

Throughout this Policy, we may refer to the term “Personal Information”. “Personal Information” is data about an individual who can be identified from that data or by combining it with other data.  Personal Information is usually your name in combination with another identifier, such as date of birth, postal address, email address, telephone number, or government-issued identification number.  The specific definition of Personal Information varies from one jurisdiction to another. 

Personal Information does not include anonymous or aggregated data that can no longer be used to identify a specific person, even if combined with other data.

Many of our customers are businesses, rather than individuals.  We do not consider Business Information, such as one’s position, business name, title, generic business email, business phone number, business address, business fax, and other similar business information, to be Personal Information.

 

What information does RTS Financial collect from you?

Some of the information we collect may be considered Personal Information. Other information is anonymous. We collect the following categories of information on our Sites, the RTS Pro mobile application, and ProTransport:

  • When you request information about RTS Financial, we ask for your first name, your company, your email address, phone number and the number of trucks you operate.
  • When you log in to our client account portal, we collect the USER ID and Password assigned to you by RTS Financial.
  • When you report a problem with our site or services, we will collect contact information along with a description of your problem.
  • When you contact us via the company email address, we will collect your contact information and any information you include in your email.
  • When you purchase services via our client portal, we may collect payment information necessary to process your transaction.
  • We may collect survey information about our services.
  • When you visit and navigate our Sites, use our applications or third-party sites, or open our emails, we may collect technical information about your use of our site including IP address, device identifier, and viewing information.
  • When you register for or use ProTransport or the RTS Pro mobile application, we collect the following information.
    • Name, mailing address, email address and phone number;
    • Unique identifiers such as RTS Pro ID; and
    • Information about your business such as company name, company size, and business type.
  • When you use ProTransport or the RTS Pro mobile application, the application will also collect:
    • Phone model;
    • Duration and frequency of your usage sessions;
    • Information regarding application crashes and screens you choose to view;
    • Other information regarding the application experience.
  • We use this information to:
    • Send you a registration confirmation;
    • Assess the needs of your business to determine suitable products;
    • Send you requested product or service information;
    • Respond to customer service requests;
    • Administer your account;
    • Send you a newsletter;
    • Contact you for marketing and sales purposes to provide you with more information about our products;
    • Improve our Sites and marketing efforts; and
    • Conduct research and analysis.

In the absence of a legal obligation to the contrary, we keep your contact information for a year after your last contact with us. 

Our Sites and RTS Pro are not directed to children under age 13 and we do not knowingly collect Personal Information from children under the age of 13.  Children under 13 should not provide their Personal Information to us through our Sites, to customer service, or in writing.  If we learn that Personal Information belonging to anyone under the age of 13 is stored on the Sites, we will immediately delete such information and refrain from using it for any purpose.

 

Other Information We Collect

In addition to collecting information directly from you as described in the previous section, we also automatically gather information when you browse or view our Sites, ProTransport or RTS Pro. For our Sites, this information may include Internet Protocol (IP) address, browser type and language, Internet service provider (ISP), referring and exit websites and applications, operating system, date/time stamp, clickstream data, and other information related to your visit. For RTS Pro and other applications, this information may include the type of phone or other mobile device you are using, the duration and frequency of your usage sessions, information regarding application crashes and screens you chose to view, gestures (i.e., taps, swipes, pinches, etc.) you use on the application, whether you are a first-time or a returning user, links you clicked on while in the application, and your flow and navigation path through the application.

We use this browsing information to make sure that the Sites, RTS Pro and other applications, and their associated parts, are functioning properly, that the Sites and applications are displayed properly for your equipment and software, and that we can provide you with information useful to your location. 

 

How do we collect information from you?

Direct Collection

We collect much of the information listed above directly from you when you submit it on our website, through RTS Pro, or on ProTransport. This includes information such as contact information, registration information and service inquiries. If you do not want to share your information, you can choose not to participate in a particular service or activity.

Indirect Collection – Cookies and Other Technology

As part of offering and providing customizable and personalized services, many websites use cookies and other online tracking technologies to store and sometimes track information about you. Our RTS Pro mobile application and ProTransport use cookies and local device storage. We may use these technologies to:

  • Provide you with personalized content based on your use of our Sites;
  • Enable you to more easily use our Sites by remembering and using contact information, purchasing information, and registration information;
  • Evaluate, monitor and analyze the use of our Sites, the RTS Pro app, and ProTransport, and analyze traffic patterns to help improve our Sites and services;
  • Assist us with ad reporting functions such as to learn which ads are bringing users to our Sites;

The types of technologies we use include:

Cookies. A cookie is a small amount of data that is sent to your browser from a Web server and stored on your computer’s hard drive. Cookies enable us to identify your browser as a unique user. Cookies may involve the transmission of information from us to you and from you to us. Cookies may also be used by another party on our behalf to transfer information to us in accordance with their privacy policy. Some cookies are "persistent cookies." They are used by us each time you access our website. Other cookies are called "session cookies." Session cookies, also called session variables, are used only during a specific browsing session and expire after a predetermined amount of time. We may use a session cookie, for example, to remember that you have already navigated through a particular menu, or that you have entered in age information for a portion of a site that is restricted by age. We may also use "analytics cookies" that allow web analytics services to recognize your browser or device and, for example, identify whether you have visited our website before, what you have previously viewed or clicked on, and how you found us. This information is provided anonymously for statistical analysis only. Analytics cookies are usually persistent cookies.

Most browsers are set to accept cookies automatically. You may disable browser cookies in your browser or set your browser to warn you when a cookie is being sent. You may lose some features or functionality when you disable cookies. Remember, also, that disabling cookies is browser specific. For example, if you log on using Internet Explorer, you must also disable cookies in Safari if you use that browser at a different time.

Web beacons, also known as clear GIFs, are often used in combination with cookies. Often transparent, these images are part of web pages, and allow us to count users who have visited certain pages and to generate statistics about how our Sites are used. They are not used to access Personal Information.

Pixel tags enable us to send email messages in a format customers can read, and they tell us whether mail has been opened. We may use this information to reduce or eliminate messages sent to customers.

Log Files. Like most standard website servers, we use log files. Log files track Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks. We utilize this information to analyze trends, administer the site, prevent fraud, track website navigation in the aggregate, and gather broad demographic information for aggregate use.

The Sites permit you to use a third-party social networking platform such as Facebook, Linked-In and Twitter. When you use these social networking platforms and plugins, your username and password and other information available about you or collected from you on these services may be shared with us. When you use social networking platforms and plugins, you share your information with them, and their privacy policy applies to disclosure of such information. In addition, they may be able to collect information about you, including your activity or may notify your connections on the social networking platform about your use of the RTS Financial's Sites. Such services may allow your activity to be monitored across multiple websites for purposes of delivering more targeted advertising. Please note that their own privacy polices apply and we encourage you to read them. We may add new social networking plugins and buttons to our websites from time to time.  You acknowledge and agree that you are solely responsible for your use of those websites and that it is your responsibility to review the terms of use and privacy policies. We are not responsible for the availability, accuracy, content, products or services of such Social Network sites.

 

Google Adwords, Google Analytics, and Third-Party Software/Service Providers

We use Google Adwords and Google Analytics in connection with our Sites to gather data such as age, gender and interests to provide advertising targeted to suit your interests and preferences.

Google Adwords and similar programs from other companies help us target our online ads based on information collected directly from you or by automated means, like cookies. These companies also use automated technologies to collect information when you click on our ads, which helps track and manage the effectiveness of our marketing efforts.

Google Analytics collects anonymous information that is not used to identify a particular user.  This information helps us better understand how visitors use our Sites, detect and defend against fraud and other security risks, and present advertisements, products, and/or services of interest to you.

We may use certain analytics solutions that may record screens visited, interaction patterns (such as screen actions, gestures, taps, and scrolls) and device details (type, version, model, and operating system). We are using the information collected to improve our app and will not collect personally identifiable information or track your browsing habits across apps. 

 

Services of Plaid Inc.

RTS uses Plaid Inc. (“Plaid”) to gather data from your financial institutions to identify and access your account(s). By using this service, you grant RTS and Plaid the right, power, and authority to act on your behalf to access and transmit your personal and financial account information to and from your relevant financial institution(s). To perform this service, RTS needs to securely store this information identifying you and your financial accounts; however, this information will not be used for any purpose other than this service and will never be sold.  You further agree to your personal and financial information being transferred, stored, and processed by Plaid in accordance with the Plaid end user privacy policy.

 

Location

You may give consent for our Sites to capture and record certain precise geo-location or global positioning data from your device in order to tailor information to your location. We may link such location data to other information that you provide to us or that may be accessed in connection with your use of our Sites. You should be able manage how your mobile device and mobile browser share location information with us, as well as how your mobile browser handles cookies and related technologies, by adjusting your mobile device’s privacy and security settings.

 

How do we use your information?

We use your Personal Information to further legitimate business interests.  Our main goal in collecting information is to improve the Sites and provide you with the best possible experience on each site. For example, by using the information we collect, we can provide you with an easy to use and readily available forum to learn about our factoring services.

We will also use your personal information to:

Who is collecting the information?

Except as provided in this Privacy Policy, only RTS Financial and our affiliates and service providers will have access to your personal account information. When you are on our Sites and are asked for personal information, you are sharing that information with RTS Financial and our affiliates and service providers. If personal data is to be collected and/or maintained by any company other than RTS Financial or its affiliates, we will try to notify you on the website or in an updated version of this Privacy Policy. If you do not want your data to be shared, you can choose not to allow the transfer by not using that particular service.

Other websites to which we link may collect personally identifiable information about you when you visit those sites. The information practices of other websites linked to our websites are not covered by this Privacy Policy.

Our employees and agents may view your Personal Information to perform their jobs and service your needs. We authorize access to your Personal Information to them on a need-to-know basis to provide you with our products or services to you, or for one of the other reasons listed in this section.

 

To whom does RTS Financial share my information?

We will not disclose any of your Personal Information except when we have your permission or under special circumstances, such as when we believe in good faith that the law requires it or under the circumstances described below. These are some of the ways that your information may be disclosed:

Service Providers

We occasionally hire other companies to provide limited services on our behalf, including packaging, delivering, or mailing, website development and operation, answering customer questions about products or services, sending postal mail or email, analyzing website use, processing payments, providing investor information and processing data. We will only provide those companies the information they need to deliver the service, and they are contractually prohibited from using that information for any other reason.

Data in the Aggregate

We may disclose “blinded” aggregated data and user statistics to prospective partners and other third parties. Blinded data is data that does not identify an individual person.

Other

We may disclose your Personal Information if we determine that disclosure is reasonably necessary to enforce our Terms of Use, this Privacy Policy or to otherwise protect our operations, clients or users.

We may release your Personal Information to others (including law enforcement) if we believe such release is reasonably necessary to comply with the law or legal process; enforce or apply the terms of applicable terms of use; detect, prevent, or otherwise address fraud, security or technical issues; or otherwise protect the rights, property or safety of others.

We may sell, transfer and/or disclose your Personal Information as part of a business divestiture, sale, merger, or acquisition of all or a part of our business.  If another company acquires our company, business, or assets, that company will possess the Personal Information collected by us and will assume the rights and obligations regarding your Personal Information as described in this Privacy Policy.  In the event of an insolvency, bankruptcy, or receivership, your Personal Information may also be transferred as a business asset.

How does RTS Financial protect financial-related information?

Keeping your personal financial information private is very important to us. As a matter of policy and long-time business practice, we do not sell information provided by our users. Any user statistics that we may provide to prospective partners regarding financial matters are provided in the aggregate only and do not include any personally identifiable information about any individual user. We will transfer your credit card number, bank account number or other personal information to the appropriate credit card company or bank in order to process any online payments.

 

What security precautions are in place to protect against the loss, misuse, or alteration of my information?

We maintain a variety of industry-standard security measures, including physical, electronic and procedural safeguards.  For example, we use SSL encryption technology for credit card numbers, bank account numbers, passwords, and registration information. Remember to sign out of your RTS Financial account and close your browser window when you have finished your work. This is to ensure that others cannot access your account by using your computer when you are away from it. Because information sent through the Internet travels from computer to computer throughout the world, when you give us information, that information may be sent electronically to servers outside of the country where you originally entered the information. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. Except as specifically stated, this site does not use security encryption measures. Information that you disclose by use of this site (as with any site that is non-secure), by posting a message or using e-mail, potentially could be collected and used by others. This may result in unsolicited messages from third parties or use of such information by third parties for their own purposes, legal or illegal. As a result, while we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit to us or from our services, and you do so at your own risk. Once we receive your transmission, we use commercially reasonable efforts to ensure its security on our systems.

In your request, please identify the Personal Information at issue and the collection, use, or disclosure you wish to stop.

Denying or withdrawing consent may not allow us to provide you with some or all of the products, services, or information you request.

 

Choice/Opt-out

You may opt-out of receiving marketing-related emails by clicking the "unsubscribe" link at the bottom of any email you receive from us. If you are having difficulty unsubscribing from our marketing communications, please contact us at legalnotices@rtsfinancial.com.

If you opt-out from receiving marketing emails or text messages, we may still need to send you communications about your, orders, customer service inquiries, and other matters.

If you agreed to receive future marketing communications directly from a third party through our Sites or Apps, you will need to contact that party to opt-out of such communications. This process may be outlined on that party's privacy policy.

 

What else should I know about my privacy?

Please keep in mind that whenever you voluntarily disclose information online, that information is accessible to other customers and users. Ultimately, you are solely responsible for maintaining the secrecy of your passwords and/or any account information. Please be careful and responsible whenever you are online. When you or we end your customer relationship with us, we will treat the information we have about you as if you were still our customer.

  

Do Not Track

Do Not Track (DNT) is a privacy preference that users can set in their web browsers. While the United States Federal Trade Commission has endorsed DNT, our website does not support DNT codes. However, except in the case of analytics cookies described above, our website limits tracking to the internal uses described above and does not enable the tracking of our users across multiple websites. Except in the case of analytics cookies described above, our website does not track your use across multiple websites, however, other websites to which we link may. Arbitration

At RTS's sole discretion, it may require you to submit any disputes arising from these Terms of Use or use of the Sites or Apps, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying Kansas law.  Your use of our Sites or Apps, therefore, constitutes a knowing waiver of any right to have any claim, defense, or other dispute related thereto adjudicated by a court and or a jury.

 

Changes to this Privacy Policy

We reserve the right to modify this Privacy Policy at any time.  Changes and clarifications will take effect immediately upon their posting on the Sites and in connection with the downloading of the Apps, and we will change the “Last Modified” date below.
